Terms and Conditions of Participation in the Harley Benton Contest

Entry into online competitions and the chance of winning, respectively, are entirely unrelated to and independent of an order of goods from Thomann GmbH. The entry into online competitions on the Thomann blog and their execution is subject to the following conditions:

  • 2 Participation

    1) Only adults are eligible for and only one person per household may enter the competition.

2) The contest will take place from 16.12.2015 up to and including 04.01.2016. In order to enter the Harley Benton Contest by Thomann, participants must adhere to the following steps and conditions during its course: it is required of the participant to build or create a guitar that functions as such after its completion from an original Harley Benton assembly kit. The use of an assembly kit from another brand is not permitted. Participants may choose their Harley Benton assembly kit freely: they may use a HB assembly kit for electric guitars, electric basses or ukuleles. All assembly kits that may be used can be found via this link. Important: the assembly kit must be procured by the participants themselves; Thomann does not provide any for free.

The creations must not have been completed in the timeframe indicated; older works, providing that they fulfil the terms and conditions of participation, may be entered into the competition. After completion, participants are to send at least five clear, informative photos of their handmade Harley Benton guitar (data size may not exceed 2 megabytes) alongside a short description of the Harley Benton model and the idea behind it, and his/her personal details (full name, customer number and telephone number) to social@thomann.de., the subject of the e-mail must be: “Harley Benton contest“. Only entries that are received by social@thomann.de within the timeframe of 16.12.2015 up to and including 04.01.2016 will be considered for the contest. The Thomann jury makes the final decision. By sending a correct email, the entrant is considered to be taking part. The winner will be notified via email and has 72 hours’ time after notification to confirm the win; failure to do so will result in the handing over of the prize to the second best entry.

 

  • 3 Exclusion from the Contest 1) Cooperation partners and employees of Thomann GmbH and their relatives (e.g. parents, siblings, spouses) are excluded from participation.

2) In the event of a breach of these terms and conditions, particularly by using unauthorised aids or manipulation in any form, the organiser reserves the right to disqualify entrants from the contest. In case of such violations, winnings may, where applicable, be denied and reclaimed.

3) Only entries received by social@thomann.de within the timeframe of 16.12.2015 up to and including 04.01.2016 will be considered for the contest.

  • 4 Execution and Settlement

1) After the jury has made its final decision, the winner will be contacted via email. After correct participation, as described above, the winners are to notify the organiser that they accept the win and include the necessary information for the awarding of the prize within the deadline of 72 hours, as described in the notification.

The right to the prize expires if the presentation or dispatch of the prize cannot be effected for reasons within the responsibility of the winner. This applies in particular when a winner does not confirm the acceptance of the prize within the aforementioned deadline. In such cases the organiser reserves the right to determine a new winner.

2) Exchanging the prize, receiving cash in lieu of the prize or other substitutes for the prize are excluded.
3) The claim to the prize or prize substitute cannot be ceded to third persons.

  • 5 Prize

1) The winner, as decided by the jury, receives a Thomann gift voucher worth 150 Euro. This will be credited to his/her Thomann customer account.

2) The prize offered in this competition is exclusively for the contest participants. Receiving cash in lieu of the prize is not possible.

  • 6 Data Protection

    1) The contestant agrees that Thomann may save all personal data necessary for the execution of the contest for its entire duration. The organiser may render services necessary for the organising and processing of the contest partly to third parties (cooperation partners). The contestants’ personal data are saved by the cooperation partner(s) for the organising and settlement of the contest for its entire duration. All personal data are deleted after the closure and processing of the contest.

By participating in this contest, the contestant agrees that his/her personal data may be processed by third parties for the stated purposes, and in particular transferred from the organiser to third parties. The contestants can at any time withdraw their consent to process their personal data. In this case, however, the organiser may have to exclude the contestants from further participation. Through the Federal Data Protection Act (Bundesdatenschutzgesetz), contestants additionally have the guaranteed rights to information and correction.

2) The organiser undertakes to protect the privacy of contestants and ensures that data will be processed in accordance with the Federal Data Protection Act (Bundesdatenschutzgesetz), the German Telemedia Act (Telemediengesetz), the European directive on data protection (95/46/EG) and the European regulatory framework on electronic communications (02/58/EG). In particular, in this regard reference will be made to the general privacy policy found at www.thomann.de/de/tho_privacypolicy.html.

 

3) All participants in this contest agree that their contest entries may be published and distributed on the internet and in other media forms. They agree that said publishing and distribution do not create any financial or other right for the participants upon Thomann. Furthermore, all contest participants agree that Thomann may use their contest entries for advertising and promotional purposes, including (but not restricted to) radio and television broadcasts, advertisements and public presentation.

 

4) The winners of this contest agree that their names (including eventual stage names) and, if applicable, photos may be used for advertising purposes related to the contest, including the publication in printed form and on the internet.

 

 

  • 6 Liability
    1) Thomann GmbH shall be freed from all liabilities on delivering the prize.2) Thomann GmbH shall not be liable for the insolvency of a cooperation partner and the consequences resulting therefrom for the carrying out and settling of the competition.

(3) Thomann accepts no responsibility or liability in the event of damage, injury or illness should this occur at any point in the contest, e.g. in the production of the instrument.

 

  • 7 Other

    1) Recourse to the courts is precluded.2) The law of the Federal Republic of Germany is exclusively applicable with the exclusion of the referral regulations under International Private Law.
